29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a. Site- An employee was not protected from crushing injuries where the employer failed to instruct each employee in the recognition and avoidance of unsafe conditions associated with employees working on foot around heavy construction equipment and remaining visible to heavy equipment operators. On or about July 27, 2023, an employee suffered severe crushing injuries after being backed over and pinned underneath the tracks of the Caterpillar (321D LCR) hydraulic excavator, where the employer did not train the employee in the safest method carrying out their job responsibilities to prevent and minimize exposure to struck by hazards.
