Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a) On or about August 01, 2023, the employer did not ensure that a program for the frequent and regular inspections of the job site, material and equipment was being completed; as a result, employees who were not utilizing a fall protection system and who had not been properly trained were exposed to a fall hazard of 20.4 ft. from the ground.

29 CFR 1926.501(b)(11): Fall Protection. Duty to have fall protection. Steep roofs. Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toe boards, safety net systems, or personal fall arrest systems. a) On or about August 01, 2023, the employer did not ensure that employees, removing an existing roof and installing a new roof at a commercial property, were protected from falling by using a complete fall protection system. As a result, employees were exposed to a fall hazard of 20.4 ft. from the ground.

29 CFR 1926.503(a)(1): The following training provisions supplement and clarify the requirements of 1926.21 regarding the hazards addressed in Subpart M of this part. Training program. The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. a) On or about August 01, 2023, the employer did not ensure that employees were trained on a fall protection systems and on hazards of falls. As a result employees who were exposed to a fall hazard of 20.4 ft. while replacing and installing an existing roof at a residential property with no fall protection.
