Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.451(g)(1)(vii):Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a) On or about August 2, 2023, at 884 Jericho Turnpike, Woodbury NY 11797, on the north side of a two story residential building, employees were installing siding while working from a pump Jack scaffold, approximately 15 feet above the ground, without a means of fall protection. b) On or about August 2, 2023, at 884 Jericho Turnpike, Woodbury NY 11797, on the east side of a two story residential building, employees were installing siding while working from a pump Jack scaffold, approximately 20 feet above the ground, without a means of fall protection. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

The bottom of the support poles did not have triangular support braces and was not secured to the structure. b) On or about August 2, 2023, at 884 Jericho Turnpike, Woodbury 11797, employees were working from a pump jack scaffold to install siding on the north side of a two-story residential building. The bottom of the support poles did not have triangular support braces and was not secured to the structure. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
