29 CFR 1926.1053(b)(22): Employees using ladders were carrying objects or loads that could cause the employee to lose balance and fall: a) On July 24, 2023, at the above addressed jobsite, employees were exposed to the hazard of falling approximately 15 feet when climbing a portable ladder carrying material to the roof. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) On July 31, 2023, at the above addressed jobsite, employees performing installation of a roof on a residential home, approximately 8 feet above the levels below, were not secured to a personal fall arrest systems or other means of fall protection, thereby exposing the employees to fall hazards. b) On July 31, 2023, at the above addressed jobsite, employees performing installation of a roof on a residential home, approximately 9 feet above the levels below, were not secured to a personal fall arrest systems or other means of fall protection, thereby exposing the employees to fall hazards. c) On July 31, 2023, at the above addressed jobsite, employees performing installation of a roof on a residential home, approximately 17 feet above the levels below, were not secured to a personal fall arrest systems or other means of fall protection, thereby exposing the employees to fall hazards. No abatement certification or documentation is required for this item. Fino Exterior, Inc. was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1539500, citation number 1, item number 1 and was affirmed as a final order on November 2, 2021, with respect to a workplace located at 330 N Ridgeland Avenue in Oak Park, Illinois.
