29 CFR  1910.134(f)(2):The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter.  a)On or about August 2, 2023, at a jobsite located at 615 N Plankinton Ave., Milwaukee, WI 53203,  the employer failed to ensure all employees using a tight-fitting facepiece respirator were fit tested prior to initial use, whenever a different respirator is used, and at least annually.

29 CFR  1926.501(b)(4)(ii):Each employee on a walking/working surface was not protected from tripping in or stepping into or through holes (including skylights) by covers.  a) On or about August 2, 2023, at a jobsite located at 615 N Plankinton Ave., Milwaukee, WI 53203, employees performing concrete repairs in a parking garage were not protected from tripping or stepping into holes, this exposed employees to possible injuries such as but not limited to, sprains, strains and bruises.

29 CFR  1926.1153(c)(1):For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a) On or about August 2, 2023, at a jobsite located at 615 N Plankinton Ave., Milwaukee, WI 53203, employees performing concrete repairs in a parking garage were using a chipping tool that did not have the proper engineering controls in place, to limit employee exposure to respirable crystalline silica.
