29 CFR  1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.  On or about May 10, 2023, the employer did not require that employees who were operating the Recycling Equipment Solutions manufactured hydraulic alligator shear adjusted the machine's guard to the size of the material being cut prior to allowing them to operate the machine. As a result, employees were exposed to amputation hazards associated with unguarded portion of the machine's shearing blades when cutting scrap metal.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
