29 CFR  1926.453(b)(2)(iv): Employee(s) were not standing firmly on the floor of the basket, were sitting or climbing on the edge of the basket, or were using planks, ladders, or other devices for a work position:  (a) On or about August 1, 2023,  the employer did not ensure that employees were protected from injury, in that an employee was conducting painting operations from the basket of a Genie S-60X boom lift and climbed from the basket onto a the roof of a three-story multifamily residential property.  This condition exposed employees to a fall of approximately 30 feet.

29 CFR  1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  (a) On or about August 1, 2023,  the employer did not ensure that employees were protected from injury, in that an employee was conducting painting operations from the basket of a Genie S-60X boom lift wan was not wearing fall protection.  This condition exposed employees to a fall of approximately 30 feet.

29 CFR  1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)  On or about August 1, 2023, the employer did not ensure that employees were protected from injury, in that an employee conducting painting operations on three-story residential multifamily residential property, was not utilizing a fall protection system.  This condition exposed employees of approximately 30 feet (9.1 m).

29 CFR  1926.503(a)(1):  The employer did not provide a training program for each employee who might be exposed to fall hazards:  (a) On or about August 1, 2023, the employer did not ensure that each employee engaged in painting operations were trained to recognize the hazards of working at elevation and trained in the use of fall protection.  Employees did not utilize fall protection when conducting painting operations on a three-story residential property.  This condition exposed employees of injuries associated with falls from heights of approximately 30 feet.  Abatement Note:  As of January 1, 1998, Subpart M of the 29 CFR 1926 part 1926.502(d) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:  a)	The nature of fall hazards in the work area; b)	The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; c)	The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;  d)	The role of each employee in the safety monitoring system when this system is used; e)	The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; f)	The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and g)	The role of employees in fall protection plans; h)	The standards contained in this subpart.
