29 CFR 1926.21(b)(3): Employees required to handle or use poisons, caustics, and other harmful substances were not instructed regarding the safe handling and use, and were not made aware of the potential hazards, personal hygiene, and personal protective measures required:  a)	NGIC Rivanna Station: On or about 07/28/2023, the general contractor provided a subcontractor with Steel Spec 1003 Shop Coat Primer to apply onto structural steel without instructing the subcontractor on the safe use of the product.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: (Construction Reference 1926.103(a))  a)	NGIC Rivanna Station: On or about 07/28/2023, the employer failed to require the subcontractor to assess the workplace (by way of personnel air sampling, or mathematical modeling, or some other means) to determine what hazardous exposure exist to employees when spraying Steel Spec 1003 Shop Coat Primer, what the exposure levels were, and what level of respiratory protection was necessary.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s):  a)	NGIC Rivanna Station: On or about 07/28/2023, the employer provided Steel Spec 1003 Shop Coat Primer to a subcontractor, directed them to use it without providing the safety data sheet and when provided was not the most current safety datasheet.   No abatement certification or documentation required.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59))  a)	NGIC Rivanna Station: On or about 07/28/2023, the employer provided a subcontractor with Steel Spec1003 Shop Coat Primer to spray structural steel without confirming subcontractor employees were trained in the hazards assoicated with the primer.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
