29 CFR  1926.25(a): During the course of construction, alteration, or repairs, form or scrap lumber with protruding nails was not kept clear from work areas:  29 CFR 1926.25(a): During the course of construction, alteration, or repairs, form or scrap lumber with protruding nails was not kept clear from work areas:  a) Custom Construction Pro Inc., 120 Seventh North Street - Left side of the house. On or about August 3, 2023, housekeeping was not maintained during construction. Roofing materials and debris accumulated in an unsafe manner exposing workers to slip and fall hazards. The employer did not ensure scrap from lumber were kept off the work-areas during construction activities.   b) Custom Construction Pro Inc., 120 Seventh North Street - Left side of the house. On or about August 3, 2023, housekeeping was not maintained during construction. Roofing material and debris accumulated in an unsafe manner exposing workers to puncture wounds should the nails protrude the worker's shoe and puncture the foot. The employer did not ensure protruding nails were kept off the work areas during construction activities.

29 CFR  1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees.  a) Custom Construction Pro Inc., 120 Seventh North Street - Left side of the house. On or about August 3, 2023, the walking working area was filled with excess roofing material and debris that had protruding nails. The employees did not wear safety shoes for protection against protruding nails. The employer failed to ensure that employees wore appropriate personal protective equipment, including but not limited to safety shoes.

29 CFR  1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  a) Custom Construction Pro Inc., 120 Seventh North Street - On the roof. On or about August 3, 2023, workers were removing and replacing the roof. The employer did not ensure that each employee was protected from fall hazards as required. Workers were exposed to falls of approximately 12 feet eave to ground during re-roofing operations without fall protection on a roof pitch greater than 4:12.

29 CFR 1926.552(a)(1): The employer did not comply with the manufacturer's specifications and limitations applicable to the operation of all hoists and elevators.   a) Custom Construction Pro Inc., 120 Seventh North Street - Front of the house. On or about August 3, 2023, employees were utilizing the lift tracks as a ladder to access and exit the roof. The employer failed to comply with the manufacturer's specifications that personnel are not allowed to utilize the RGC lift as a ladder.   b) Custom Construction Pro Inc., 120 Seventh North Street - Front of the house. On or about August 3, 2023, employees were utilizing the material lift approximately three feet from the power supply line. The employer failed to comply with the manufacturer's specifications that hoist operations must be clear of all electrical lines to prevent injury.   c) Custom Construction Pro Inc., 120 Seventh North Street - Front of the house. On or about August 3, 2023, employees were utilizing the material lift when its base was approximately five feet from the face of the exterior wall  . The employer failed to comply with the manufacturer's rise/run specifications.

29 CFR  1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface the ladders length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigged support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.  a) Custom Construction Pro Inc., 120 Seventh North Street - Left side of the house. On or about August 3, 2023, workers were performing roofing activities and used an aluminum extension ladder to access and exit the roof at 12 feet eave to ground. The ladder side rails did not extend at least 3 feet above the upper landing. The employer did not ensure the ladder rails extended at least 3 feet above the upper landing.

29 CFR  1926.1053(b)(9): The employer did not ensure the area around the top and bottom of ladders shall be kept clear.  a) Custom Construction Pro Inc., 120 Seventh North Street - Left side of the house. On or about August 3, 2023, workers were utilizing an aluminum ladder to access and exit the roof. The area around the bottom of the ladder was congested with roofing debris and material that was tossed from the roof. The area around the bottom of ladders were not kept clear as required.
