Employees operating in this condition were exposed to a 7ft fall to the ground below.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:(a) a) Ovidio Mendez Lopez, on or about August 3, 2023 at the address of 524 James Way, Marion OH: The employer did not ensure the side rails of two portable aluminum extension ladder was extended at least three feet above the landing surface. Approximately 15 employees were exposed to falls of 7 feet to the ground below while using the ladder(s) to transition to and from the roof level.
