29 CFR  1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift.  On or about August 4, 2023, and a times prior thereto, employees were working with aerial lifts doing metal framing work on a new construction carwash without the use of fall protection, exposing the employees to a fall hazard of over 6-feet to the ground below.

29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about August 4, 2023, and a times prior thereto, employees were working on the metal framing of a new construction carwash without the use of fall protection, exposing the employees to a fall hazard of over 6-feet to the ground.

29 CFR  1926.503(b)(1): The employer did not verify fall protection training by preparing a written certification record.  On or about August 4, 2023, and at times prior thereto, the employer permitted his employees to work at heights above 6 feet without certifying that the employees have been trained to recognize and select appropriate fall protection, exposing the employees to fall hazards of over 6-feet to a lower level.

29 CFR  1926.602(c)(1)(ii): Modifications or additions affecting the safe operation of the equipment were  made without the manufacturer's written approval.  On or about August 4, 2023, and times prior thereto, a metal scaffold platform was being used with a forklift without approval from the manufacturer, exposing the employees to hazards such as but not limited to fall hazards and struck by falling loads.

29 CFR  1926.602(d): The employer did not ensure that each employee operating a powered industrial vehicle had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.  and as referenced by the note contained in 1926.602(d).    On or about August 4, 2023, and at times prior thereto, employees were operating powered industrial trucks without the employer providing the required training to safely operate the equipment, exposing employees to hazards such as, but not limited to being struck by a powered industrial truck and being struck by loads or falling objects.
