29 CFR  1926.453(b)(2)(iv): Employee(s) working in an aerial lift were not standing firmly on the floor of the basket.  On or about August 4, 2023, and times prior thereto, an employee was climbing over the rails of an aerial lift to gain access to a commercial metal building under construction, exposing the employee to a fall hazard of over 6-feet to the ground.

29 CFR  1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift.  On or about August 4, 2023, and at times prior thereto, an employee was using an aerial lift to perform metal framing work at heights ranging from 6 to 36 feet high without the use of fall protection, exposing the employee to a fall hazard.

29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about August 4, 2023, and a times prior thereto, employees were working on the metal framing of a new carwash under construction at heights of approximately 23 to 36 feet without the use of fall protection, exposing the employees to a fall hazard.

29 CFR  1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  On or about August 4, 2023, and at times prior thereto, the employer permitted his employee to work at heights above 6 feet without certifying that the employee had been trained to recognize and select appropriate fall protection, exposing the employee to fall hazards of over 6-feet to the ground below.
