29 CFR  1910.147(c)(7)(i):  The employer shall provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees:   At a facility located at, at a facility located at 3399 South Ridge Road in Green Bay, WI; the employer did not provide training to ensure that employees:  a) Understood the purpose and function of the energy control program. Employees did not receive training to implement lockout/tagout when conducting servicing in the form of setup on the Milliken machines and in the form of jam clearing on the Gluer machine in the Custom Pak area.  b) Acquired the knowledge and skills required for the safe application and usage of energy controls. Employees did not received training to verify that isolation and deenergization of the machines had been accomplished when employees conducted servicing and maintenance of sour cream processing equipment, in the form of sanitation, on machines such as but not limited to the Milliken machines, sour cream pumps, Autoprod Filler, DEL Capper and Gluer machines located in the Milliken and Custom Pak areas.

29 CFR  1910.147(d):  The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence:  At a facility located at 3399 South Ridge Road in Green Bay, WI; employees were exposed to machine hazards associated with moving parts when they engaged in:  a) Clearing jams on the Gluer machine in the Custom Pak area. On or about August 8, 2023, the employer did not ensure that employees implemented energy control application steps or equipment protective measures prior to allowing them to clear jams and clean the interior of the Gluer machines. The machine was not deenergized prior to the employees engaging in the servicing and maintenance activities.  b) Filler head cleaning activities as part of sanitation on the Autoprod Filler (Model 1x6FILLER, Serial #1950). On or about January 12, 2024, the employer did not ensure that employees implemented energy control application steps or equipment protective measures prior to allowing them to manually wipe the filler heads on the Autoprod Filler machine. The machine was not deenergized prior the the employees engaging in the servicing and maintenance activities.  c) Setup activities on equipment such as, but not limited to the Milliken machines (Model MP-310). On or about August 9, 2023, the employer did not ensure that employees implemented energy control application steps or equipment protective measure prior to allowing them to setup the Milliken machines. The machines were not deenergized prior to the employees engaging in the servicing and maintenance activities.  d) Sanitation activities on equipment such as, but not limited to the Milliken machines (Model MP-310), Autoprod Filler (Model 1x6FILLER, Serial #1950), DEL Capper (Model DEL INSERTER, Serial # DEL-101), Gluer machine in the Custom Pak area, and sour cream pumps in both the Milliken and Custom Pak areas. On or about January 12, 2024, the employer did not ensure that employees implemented verification of isolation and deenergization prior to allowing them to clean and sanitize the machines. The machines were not deenergized prior to the employees engaging in the servicing/maintenance activity.  As a result, the applicable energy control elements, involving preparation for shutdown [1910.147(d)(1)], machine shutdown [1910.147(d)(2)], machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine hazards.

29 CFR  1910.178(l)(4)(iii):  An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years:  On or about August 8, 2023, at a facility located at 3399 South Ridge Road in Green Bay, WI; the employer did not conduct evaluations of each powered industrial truck operator's performance at least once every three years. Management employees who had not been certified for three years had not been reevaluated prior to being allowed to operator electric forklift lifts at the facility.

The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation:  On or about August 8, 2023, at a facility located at 3399 South Ridge Road in Green Bay, WI; the employer did not certify that each operator had been trained and evaluated as required by paragraph (l). Employees operating forklifts and a truck trailer hauling yard spotter were not certified by the employer that they had been trained and evaluated on the operations of those powered industrial vehicles.

29 CFR  1910.212(a)(1):  One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.:  On August 8, 2023, at a facility located at 3399 South Ridge Road in Green Bay, WI; the employer did not provide one or more methods of machine guarding to protect operators and other employees from:  a) Ingoing nip points created by the two Milliken machines (Model MP-310) where the belts and pullies of the machines fed packaging material into the filling portions of the machines.  b) Struck-by and caught-between hazards created by the kicker mechanism of the Loveshaw Case Sealer (Model LD16X, Serial #220202416A) for the Milliken line.  c) Ingoing nip points and entanglement hazards created by the screw conveyor of the Autoprod Filler (Model 1x6FILLER, Serial #1950), which advanced sour cream containers through the filling heads of the machine, in the Custom Pak department.   d) Ingoing nip points created by plastic conveyors as they ran over pullies located on the underside of the conveyors, which were located between the Gluer machine and where containers exited the Custom Pak room through the wall.
