29 CFR 1910.95(g)(1):The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: Shop: On or about September 20, 2023, an employee was exposed to an 8-hour time weighted average noise level of 92.0 dBA (equivalently a dose of 204% in excess of the 85 dBA (equivalently a dose of 50%) while grinding and polishing stone counter tops. An audiometric program was not maintained.

29 CFR 1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f)labeling (g) safety data sheets, and (h) information and training will be met: Fabrication Shop and Customer Sites: A written hazard communication program had not been maintained and implemented where employees used glues, solvents, and propane and were exposed to silica dust during cutting, grinding, and polishing of granite and quartz stone products.
