29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): Employees were allowed to operate powered industrial trucks (e.g. the company's fork trucks) at the site without having received formal instruction, including operator evaluation to determine the retention of the information. On or about August 8, 2023, an untrained employee(s) was authorized to operate a (Toyota) electric fork truck at the facility. Tasked with loading and unloading pallets, the untrained operator potentially exposed others working in the immediate area(s) to struck by and/or caught in or between hazards, if control of the fork truck were compromised.

29 CFR 1910.178 (l)(6): Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation: On or about August 8, 2023, the employer failed to ensure that supervisors, and the senior manager who operated the company's (Toyota) electric fork trucks when loading and unloading pallets, had been certified to operate the PITs thus potentially exposing others in the immediate area to struck by or caught in or between hazards.
