29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): (a) On or about August 7th, 2023, at 7525 Red River Road West Wahpeton, ND, employees of ICS were exposed to unprotected edges while performing welding repairs on the diffusion tower at heights up to 55 feet without proper fall protection.

29 CFR 1910.1026(d)(2)(i): The employer using the scheduled monitoring option did not perform initial monitoring to determine the 8-hour time-weighted average exposure to chromium (VI) for each employee on the basis of a sufficient number of personal breathing zone air samples to accurately characterize full shift exposure on each shift, for each job classification, in each work area: (a) On or about and at times prior to August 7th, 2023, at 7525 Red River Road West Wahpeton, North Dakota, the employer did not conduct initial monitoring for chromium (VI) for welders who were welding on stainless steel inside of a diffusion tower.
