29 CFR  1926.651(j)(2):Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  On or about July 24, 2023, at a job-site located at 6314 Michael DR, Brook Park Ohio 44142; the employer did not ensure employees were adequately protected from rolling and or falling debris from a spoil pile that was located directly at the edge of the South side of the trench. An employee was working in the 6 foot deep trench attempting to locate the waterline break (leaking water) directly below the loose material at the edge of the trench.

29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  On or about July 24, 2023, at a job-site located at 6314 Michael DR, Brook Park Ohio 44142; the employer did not ensure adequate cave-in protection was used to protect an employee working inside a trench with near vertical side walls and a depth varying from approximately 6 feet.  The trench was determined to have type "B" soil.
