29 CFR 1926.95(a): Personal protective equipment was not used to mitigate or eliminate hazards which were capable of causing injury or impairment in the function of any part of the body through physical contact. Location: 704 Townsend Road, Groton, MA; On or about 08/09/2023, the excavator operator utilized the Komatsu excavator (Model#: PC170LC-10 / Serial#:30850) without utilizing the seatbelt which is identified throughout the manufacturer instructions and on the ROPS tag mounted on the equipment as a mandatory form of PPE which the operator is required to wear during operation of the equipment.

29 CFR 1926.602(b)(3): Safety requirements, ratios, or limitations applicable to machines or attachment usage covered in Power Crane and Shovel Associations Standards No. 1 and No. 2 of 1968, and No. 3 of 1969 were not complied with. Location: 704 Townsend Road, Groton, MA; On or about 08/09/2023, safety requirements covered in Powered Crane and Shovel Associations Standard (PCSA) No. 3 of 1969 under paragraph 8.3.3 (C); "Operation - Established operating safety rules where applicable should be observed in performing all operating functions. Operating safety rules are found in sources such as the following: C. Manufacturer's Care and Operation Manual", were not followed when a seatbelt was not worn per the manufacturer's instructions for safe operation of the Komatsu excavator (Model#: PC170LC-10 / Serial#:30850).
