29 CFR 1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person. Location: Throughout the construction site located at 35 Garvey Street, Everett MA On or about 8/8/2023, several hazards existed on a commercial construction site in areas readily accessible to employees on site. Instance A: All protruding reinforcing steel, onto and/or into which employees could fall, was not guarded to eliminate the hazard of impalement. Instance B: Toeboards were not erected along the edge of the overhead walking/working surface for a distance sufficient to protect employees below. Instance C: Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed. Instance D: Non-self-supporting ladders were not used at an angle such than the horizontal distance from the top support to the foot of the ladder way approximately one-quarter of the working length of the ladder. Instance E: The area around the top and/or bottom of (a) ladder(s) was not kept clear. Instance F: Employees in a hoist area were not protected from falling 6 feet (1.8 m) or more to lower levels by guardrail systems or personal fall arrest systems.
