29 CFR  1910.106(e)(9)(iii): "Waste and residue." Combustible waste material and residues in a building or unit operating area shall be kept to a minimum, stored in covered metal receptacles and disposed of daily.  On or about August 3, 2023, with regard to an establishment located at 2221 Innovation Drive, De Pere, WI 54115, the employer did not ensure that combustible waste products such as, but not limited to, cleaning rags with lacquer or degreaser on them were disposed of in covered metal containers and disposed of daily.

29 CFR  1910.252(a)(2)(vii): Relocation of combustibles. Where practicable, all combustibles shall be relocated at least 35 feet (10.7 m) from the work site. Where relocation is impracticable, combustibles shall be protected with flameproofed covers or otherwise shielded with metal or asbestos guards or curtains.  On or about August 3, 2023, with regard to an establishment located at 2221 Innovation Drive, De Pere, WI 54115, the employer did not ensure that employees using combustible material, such as Sherwin William Lacquer Thinner K22, had located that material at least 35 feet from the worksite or protected the material with flameproof covers or adequate shielding.

29 CFR  1910.106(e)(6)(ii): Grounding. Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 �F (37.8 �C), shall not be dispensed into containers unless the nozzle and container are electrically interconnected. Where the metallic floorplate on which the container stands while filling is electrically connected to the fill stem or where the fill stem is bonded to the container during filling operations by means of a bond wire, the provisions of this section shall be deemed to have been complied with.  On or about August 3, 2023, with regard to an establishment located at 2221 Innovation Drive, De Pere, WI 54115, employees dispensing Sherwin William Lacquer Thinner K22 into secondary metal containers did not ensure that the containers were bonded prior to conducting the filling operation.

In the use of cleaning materials, because of their possible toxicity or flammability, appropriate precautions such as manufacturers instructions shall be followed.  On or about August 3, 2023, with regard to an establishment located at 2221 Innovation Drive, De Pere, WI 54115, the employer did not ensure that employees using chemicals such as, but not limited to, Sherwin Williams Lacquer Thinner K22 and Sprayway Black Label D3 Citrus Degreaser were using appropriate precautions against flammability hazards as identified in the manufacturers instructions.
