29 CFR  1910.134(e)(1):  The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator:  (Construction Reference 1926.103)  On August 10, 2023, at a worksite located at  333 W. Cecil Ave. in Neenah, WI; the employer did not provide medical evaluations to determine employees' ability to use abrasive blasting helmet respirators which they used during abrasive blasting on the inside of a water tower tank.

29 CFR  1910.134(i)(7):  For oil-lubricated compressors, the employer shall use a high-temperature or carbon monoxide alarm, or both, to monitor carbon monoxide levels. If only high-temperature alarms are used, the air supply shall be monitored at intervals sufficient to prevent carbon monoxide in the breathing air from exceeding 10 ppm: (Construction Reference 1926.103)  On August 10, 2023, at a worksite located at  333 W. Cecil Ave. in Neenah, WI; employees wore abrasive blasting helmet respirators which were provided breathing air by an oil-lubricated Sullair compressor (Model 1600 HAF CAT). The employer did not have an integrated carbon monoxide alarm and was not monitoring breathing air for carbon monoxide while employees wore the respirators during abrasive blasting on the inside of a water tower tank.

29 CFR  1926.307(d)(1):  Pulleys, any parts of which are 7 feet (2.128 m) or less from the floor or working platform, shall be guarded in accordance with the standards specified in paragraphs (m) and (o) of this section:  On August 10, 2023, at a worksite located at 333 W. Cecil Ave. in Neenah, WI; pullies on the motor of the dust collector equipment were less than 7 feet from the floor and were not guarded to prevent employees from entanglement hazards.

On August 10, 2023, at a worksite located at 333 W. Cecil Ave. in Neenah, WI; employees conducting abrasive blasting inside in the water tower were not protected from falling through a hole in the walking/working surface of the water tower.

29 CFR  1926.503(b)(1):  The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training:  On August 10, 2023, at a worksite located at 333 W. Cecil Ave. in Neenah, WI; the employer did not verify through written certification that employees had been provided training to recognize fall hazards and the procedures to minimize falls as described in paragraph (a) of this section. The employer did not certify that employees who were exposed to fall hazards while working from elevated platforms, climbing fixed ladders and walking/working on surfaces with holes, had been trained.
