OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by fragments of Polyvinyl Chloride (PVC) plastic pipe in the event that the PVC plastic pipe ruptured:  a) 160 Ken Lane, Newton, AL 36352, Air compressor area behind paint booth; On or about August 10, 2023 and times prior the employer exposed employees to the hazard of being struck by fragments of Polyvinyl Chloride (PVC) plastic pipe in the event that the PVC plastic pipe ruptured due to the employer utilizing PVC plastic piping  in exposed above ground locations to transport compressed air to locations such as, but not limited to, the paint booth.

29 CFR 1910.212(a)(1):One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  a) Machine Shop, Hyd-Mech S-20A Industrial Band Saw; On or about August 9, 2023 and times prior employees were exposed to amputation hazards in that the employer failed to ensure the Hyd-Mech S-20A Industrial Band Saw blades were guarded.
