29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On or about August 10, 2023, and at times prior thereto, the employer did not ensure that employees were wearing hardhats while working below other employees during bricklaying operations. Thus exposing employee(s) to a struck-by hazard from falling objects.  Jaime Aguilar was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.100(a)), which was contained in OSHA inspection number 1651240, citation number 1, item number 2 and was affirmed as a final order on March 1, 2023, with respect to a workplace located at 209 McConathy Way, Flower Mound, TX 75022.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)  On or about August 10, 2023, and at times prior thereto, employees were performing masonry activities while on a welded frame scaffold that was not fully planked, exposing employees to fall hazards. On or about August 10, 2023, and at times prior thereto, employees were performing masonry activities on a welded frame scaffold without toeboards, exposing employees to a struck-by hazard. 29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  On or about August 10, 2023, and at time prior thereto, employees were working on a welded frame scaffold without ladder access/egress. The employees climbed the ends and cross bracing exposing them to a fall hazard.  Jaime Aguilar was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.451(e)(1)), which was contained in OSHA inspection number 1651240, citation number 1, item number 5/a, and was affirmed as a final order on March 1, 2023, with respect to a workplace located at 209 McConathy Way, FLOWER MOUND, TX 75022.
