29 CFR 1910.107(b)(9): A clear space of not less than 3 feet on all sides was not kept free from storage or combustible construction: At the commercial facility located at 301 East Scott Street in Marceline, Missouri 64658, on or about August 2, 2023: Employees working at the facility were exposed to fires and explosions when performing spray-painting operations in spray booth areas when flammable and combustible materials were stored within 3 feet outside the spray booths. The employer did not ensure that the spray booths were kept free of stored materials and were accessible at all times. 1) Spray Booth 1 had a flammable cabinet placed between booths 1 and 2, to the right of the booth. The cabinet was stored within 3 feet of the exterior of the spray booth, blocking access to the back of the booth. 2) Spray Booth 2 had a flammable storage cabinet stored within 3 feet of the exterior of the spray booth and a metal shelving cabinet to the left of the booth, blocking access to the back of the booth. 3) Spray Booth 3 had another metal cabinet for tools and equipment placed between booths 3 and 4, within 3 feet of the exterior of the booth, blocking access to the back of the booth. 4) Spray Booth 4 had a garbage container to the left of the booth placed within 3 feet of the exterior of the spray booth, and on the opposite side the booth that drying racks placed within 3 feet of the exterior of the booth.

At the commercial facility located at 301 East Scott Street in Marceline, Missouri 64658, on or about September 13, 2023, and thereafter: Employees working at the facility were exposed to fires, and burns, when performing spray-painting operations in spray booth areas that are used to spray different types of paint applications. The spray areas had an accumulation of paint, coatings, and stains residue as all the booths are used interchangeably throughout the day based on the production requirements.
