29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: At the commercial facility located at 3210 E 85th Street, Kansas City, Missouri 64132, on or about July 25, 2023: Employees were exposed to respiratory hazards including asthma, trouble breathing, and claustrophobia when the employer required employees to wear respirators before ensuring that a medical evaluation was performed to determine each employee's ability to wear a respirator. The employees wear N95 respirators and half-face elastomeric tight-fitting respirators when performing smaller tasks in the reclamation area.

29 CFR 1910.134(f)(1): The employer shall ensure that employees using a tight-fitting facepiece respirator pass an appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT) as stated in this paragraph. At the commercial facility located at 3210 E 85th Street, Kansas City, Missouri 64132, on or about July 25, 2023: Employees were exposed to respiratory hazards including trouble breathing, asthma, or undetected medical conditions from airborne lead particles. The employees were provided with half-face elastomeric tight-fitting respirators and N95 respirators without having an appropriate fit testing performed before allowed to wear the respirators. The employer did not provide fit testing to employees that required to wear tight-fitting respirators before initial use.
