29 CFR  1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:  a) 9155 W Fairview Littleton, CO (Next Level Constructors): On or about August 14, 2023, and at times prior, employees were exposed to struck-by and fall hazards from scaffolding that was not regularly inspected. The employer failed to ensure there was no potential danger of tools, or materials, from striking other employees in lower levels as well as failing to provide mid-rails or cross member sections in portions of the scaffold exposing employees to fall hazards greater than 10 feet.

29 CFR  1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person.   a) 9155 W Fairview Littleton, CO (Next Level Constructors): On or about August 14, 2023, and at times prior, employees were exposed to scaffolding that was not erected under the supervision of a competent person. The scaffold was missing cross member sections, mid rails on upper section and did not have toe-boards installed.

29 CFR  1926.451(g)(4): Guardrail systems installed to meet the requirements of this section did not comply with the provisions listed in subparagraphs (i) through (xv) of this paragraph.  a) 9155 W Fairview Littleton, CO (Next Level Constructors): On or about August 14, 2023, and at times prior, employees were exposed to an open edge. The employer failed to ensure employees were protected from falling to lower levels from the second level of the scaffolding (14.2 feet) by installing complete guardrails. The employer installed the scaffolding so that the second level only had a top rail. There were no cross bars or mid rails installed on the second level.

29 CFR  1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.  For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall.   a) 9155 W Fairview Littleton, CO (Next Level Constructors): On or about August 14, 2023, and at times prior, employees were exposed to falling objects. The employer failed to ensure there was no potential danger of tools, materials, or equipment falling from a scaffold and striking employees below.
