29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a) On or about 08/14/2023, at a home and garage roof project located at 6619 Transit Rd, Williamsville, NY; employees were painting on the roof of a two story hotel. The roof had multiple pitches including an 5 in 12 pitch with an eave height of approximately 20 feet. There was no fall protection in use. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.453(b)(2)(v): A body belt (harness) shall be worn and a lanyard attached to the boom or basket when working from an aerial lift: a) On or about 08/14/2023, during the painting of a roof of a located at 6619 Transit Rd Williamsville, NY; the employer did not enforce the use of fall protection to employees working in the basket of an aerial boom lift, 18 feet above lower levels. Employees were allowed to work in an articulating boom without the use of Personal Fall Arrest Systems and "tying off" to the boom basket with a lanyard. NO ABATEMENT CERTIFICATION REQUIRED
