29 CFR 1910.95(g)(5)(ii): Where mobile test vans were used to meet the audiometric testing obligation, the employer did not obtain a valid baseline audiogram within 1 year of an employee's first exposure at or above the action level: (a) AAA Hellenic Marble Inc. located at 301 East Market Street West Chester, PA: On or about August 15, 2023, the employer did not establish a baseline audiogram for employees performing polishing activities and exposed to continuous noise levels equivalent to 93.4% of the allowable 50% dose for an 8 hour time-weighted average (TWA). This exposure is equivalent to an 8-hour TWA of 89.5 dBA, exceeding the OSHA Action Level of 85.0 dBA for an 8-hour TWA. Sampling time was 293 minutes. Zero exposures were assumed for all unsampled time periods.

29 CFR 1910.95(k)(2): The training program was not repeated annually for each employee included in the hearing conservation program: (a) AAA Hellenic Marble Inc. located at 301 East Market Street West Chester, PA: On or about August 15, 2023, the employer did not provide annual training for employees working performing polishing activities and included in the hearing conservation program. Employees performing polishing activities and exposed to continuous noise levels equivalent to 88.3% and 93.4% of the allowable 50% dose for an 8 hour time-weighted average (TWA). These exposures are equivalent to an 8-hour TWA of 89.1dBA and 89.5 dBA respectively, exceeding the OSHA Action Level of 85.0 dBA for an 8-hour TWA. Sampling times were 111 and 293 minutes respectively. Zero exposures were assumed for all unsampled time periods.

29 CFR 1910.1053(j)(3)(i): The employer did ensure that each employee covered by this section could demonstrate knowledge and understanding of the health hazards associated with exposure to respirable crystalline silica; specific tasks in the workplace that could result in exposure to respirable crystalline silica; specific measures the employer has implemented to protect employees from exposure to respirable crystalline silica; the contents of this section; and the purpose and a description of the medical surveillance program required by paragraph (i) of this section: (a)AAA Hellenic Marble Inc. located at 301 East Market Street West Chester, PA: On or about August 15, 2023, the employer did not provide employees with information and training on hazards associated with task generating silica dust and measures needed to be implemented to protect employees. Employees engaged in polishing activities of natural stone and quartz were exposed to crystalline silica dust.
