29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. a) On or about 08/17/2023, throughout the warehouse; employees were exposed to struck/crushed by hazards when the employer did not ensure a Powered Industrial Vehicle (PIV) Training Program, consisting of practical training and evaluations, was in place and provided to new employees operating PIVs. Employees operated PIVs such as, but not limited to: Yale Lift Truck Model OS030ECN24TE089 Serial # C801N05951D. Powered industrial vehicles are used to move materials throughout the buildings. ABATEMENT DOCUMENTATION REQUIRED

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: a) On or about 08/17/2023, throughout the establishment, employees were exposed to struck/crushed by hazards when the employer did not ensure employees with prior Powered Industrial Vehicle (PIV) experience were evaluated in the safe operation and working conditions of the workplace at least once every three years. Last evaluations expired approximately 2019. Employees operate PIVs such as, but not limited to; Yale Lift Truck Model OS030ECN24TE089 Serial # C801N05951D to move materials throughout the facility. ABATEMENT CERTIFICATION REQUIRED
