On or about August 18, 2023, the employer did not comply with the requirements of Table 1 of the standard when an employee was observed working in a visible cloud of dust while using a STIHL TS 420 Concrete Cut-Off Saw, without a water suppression system to cut the sidewalk, and the employer had not conducted an exposure assessment to determine the employee's exposure.

29 CFR 1926.1153(i)(2)(i): The employer did not ensure that employees covered by this section could demonstrate knowledge and understanding of at least the requirements outlined in 29 CFR 1926(i)(2)(i)(A) through (F) where there was exposure to respirable crystalline silica: a.) On or about August 18, 2023, an employee was observed working in a visible cloud of dust while using a STIHL TS 420 Concrete Cut-Off Saw, without a water suppression system, to cut the sidewalk, and the employee had not received training related to respirable crystalline silica hazards and the requirements of the standard.
