29 CFR 1926.651(k)(1):An inspection was not conducted by the competent person to identify evidence of hazardous conditions as needed throughout the shift. (a) On or about 08/17/23 during the erection of a commercial building , located on 140 South Union Street, in Spencerport, New York, the employer did not conduct inspections to identify hazardous conditions where unattended excavations were not barricaded and exposed workers from slipping or tripping into an open unprotected excavation. NO ABATEMENT CERTIFICATION REQUIRED
