29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. a) Baja Construction LLC located at 299 Dickenson, Building 9, Columbus, Ohio 43215: On and preceding August 18, 2023, the employer failed to initiate and maintain a fall protection program for employees working from the elevated platform of an aerial lift. An employee, without fall protection, was working from the elevated platform of an aerial lift while installing Tyvek to the exterior of a building, thereby exposed to a 16-foot fall hazard.

29 CFR 1926.453(b)(2)(v):A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). a) Baja Construction LLC located at 299 Dickenson, Building 9, Columbus, Ohio 43215: On and preceding August 18, 2023, the employer did not ensure that employees who worked from aerial lifts were protected from falls. An employee, without fall protection, was working from the elevated platform of an aerial lift while installing Tyvek to the exterior of a building, thereby exposed to a 16-foot fall hazard.
