29 CFR  1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a. Miguel Cardenas, located at 3175 Briarwood Lane, Lot 8860, Lewis Center, OH 43035: The employer did not ensure employees exposed to falls were provided with a fall protection training program. Employees engaged in residential framing activities working at heights of over 22 feet, were not trained on the recognition of fall hazards and the procedures to be followed to minimize the hazards.

29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  a. Miguel Cardenas, located at 3175 Briarwood Lane, Lot 8860, Lewis Center, OH 43035: On or about August 18, 2023, employees were performing framing work with the use of pneumatic nailers on the roof of a new-build residential home at heights of over 22 feet without fall protection and eye protection. The employer did not initiate and maintain safety and health programs related to the framing work being conducted.  Miguel Cardenas was previously cited for a repeat-serious violation of this Occupational Safety and Health standard 1926.20(b)(1), which was contained in OSHA inspection number 1511834, citation number 1, item number 1a and was affirmed as a final order on June 14, 2021, with respect to a workplace located at 7300 Cotton Wood Drive, Plain City, OH 43064.  Miguel Cardenas was previously cited for a violation of this Occupational Safety and Health standard 1926.20(b)(1), which was contained in OSHA inspection number 1359143, citation number 1, item number 1 and was affirmed as a final order on January 16, 2019, with respect to a workplace located at Lot 1877 Poplar Place, Lewis Center, OH 43035.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. Miguel Cardenas, located at 3175 Briarwood Lane, Lot 8860, Lewis Center, OH 43035: On or about August 18, 2023, employees  were operating pneumatic nailers to perform framing work without eye protection. The following condition exposed employees to a struck-by hazards.  Miguel Cardenas was previously cited for a violation of this Occupational Safety and Health standard 1926.102(a)(1), which was contained in OSHA inspection number 1359143, citation number 1, item number 3 and was affirmed as a final order on January 16, 2019, with respect to a workplace located at Lot 1877 Poplar Place, Lewis Center, OH 43035.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a.
