29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  On August 15, 2023, employees of Amaya Construction LLC, were re-roofing a residential building located at 46 and 48 Prairie Hill Drive in Troy, Missouri.  Employees were using pneumatic nail guns without eye protection. The employees were exposed to struck-by hazards.

29 CFR 1926.1053(b)(1):  When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access:  On August 15, 2023, employees of Amaya Construction LLC, were re-roofing a residential building located at 46 and 48 Prairie Hill Drive in Troy, Missouri. The employer did not ensure a ladder placed on the North side of the residence was positioned so the side rails extended three feet above the upper landing surface. The employees were exposed to fall hazards.

29 CFR 1926.501(b)(13): "Residential construction." Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest systems:  On August 15, 2023, employees of Amaya Construction LLC, were re-roofing a residential building located at 46 and 48 Prairie Hill Drive in Troy, Missouri.  The employer did not ensure employees utilized a guardrail system, safety net system or personal fall arrest system.  The employees were observed working on a 6:12 pitch roof approximately 10 feet above the lower level without fall protection.  Amaya Construction LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1558907, citation number 1, item number 4 and was affirmed as a final order on January 4, 2022, with respect to a workplace located at 113 Golden Gate Parkway in Wentzville, MO.
