29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  On or about 08/17/2023 at the site located at 6765 Buckley Road, Syracuse, NY, 13212: The employer failed to provide an SOP addressing hazards while working on low sloped roofs to the Syracuse Area Office as contained in the stipulated settlement which became a final order on September 29, 2025. An abatement demand letter was sent to the employer on February 13, 2026.

29 CFR  1926.416(a)(1): The employer did not prevent employee(s) from working in proximity to an electric power circuit that the employee could contact during the course of work and the employee(s) were not protected against electric shock by de-energizing the circuit and grounding it or by guarding it effectively by insulation or other means:  a) 6765 Buckley Road, Syracuse, NY, 13212: On or about 08/17/2023, the employer did not protect employee(s) from possible electrical shock when roofers were using multiple tools, including but not limited to a metal shovels  in close proximety to a  240-Volt electrical line.

29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.  a) 6765 Buckley Road, Syracuse, NY 13212: On or about 8/17/2023, the employer did not ensure employees engaged in roofing activities on low-slope roofs with unprotected sides, with and a fall distance of greater than 9 feet, were not protected by guardrail systems, safety net systems, personal fall arrest systems and/or and safety monitoring system.  Oneida Lake Builders, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(10) , which was contained in OSHA inspection number 1632953, citation number 1, item number 1 and was affirmed as a final order on 5/18/2023, with respect to a workplace located at 101 Montrose Ave, Solvay, NY 13209.
