29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck (a) Warehouse Area; On or about July 13, 2023 and at times prior to, employees were operating the Hyster forklift #H110XL. Training and evaluation was not conducted for new employees and/or training was not conducted every three years as required by the standard.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service, in which could adversely affect the safety of the vehicle: (a) Warehouse Area; On or about July 13, 2023 and at times prior to, employees were operating the Hyster forklift #H110XL without adequate inspections prior to being placed in service. The forklifts windshield was cracked and a counterbalance was attached so that the forklift would not tip over when carrying heavy granite product. These hazards could adversely affect the safety of the vehicles which could carry 1,000-6,000 pounds of granite at one time.
