On or about August 22, 2023 at the address of 129 Dixie Highway Rossford, OH 43460. The employer did not seek or ensure manufacture's approval for modifications to the Yale Lift Truck's (model: ERC060GHN36TF094 ) fork(s), such as a fabricated hole near the fork tip prior to use. Employee(s) utilizing the Yale Lift Truck in this condition to handle tools and equipment, without the benefit of the manufacture's evaluation and approval were exposed to hazards associated with load loss and displacement.

1910.178(o)(5) A load engaging means shall be placed under the load as far as possible; the mast shall be carefully tilted backward to stabilize the load. 29 CFR 1910.178(o)(1): Load(s) on powered industrial truck(s) were not stable or safely arranged: a) Industrial Power System, Inc. On or about August 22, 2023 at the address of 129 Dixie Highway Rossford, OH 43460. The employer did not ensure that only stable or safely arranged loads were handled. Employee(s) utilizing the Yale Lift Truck (model: ERC060GHN36TF094) to hoist tools and equipment by way of "free rigging" (placing unsecured rigging on the fork(s), for a below-the-fork material handling) were exposed to hazards associated with load displacement and loss of stability.
