29 CFR  1910.178(l)(2)(ii):The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  On or about August 14, 2023 the employer S & G Stores II LLC DBA S & G Convenience Stores Store #90 at jobsite located at 900 American Rd., Napoleon, OH 43545, failed to ensure that employees operating a powered industrial vehicle (Yale lift truck - Model: GLP050LXNVAE087 S/N: A974V04070M) were adequately trained. Untrained forklift operators are hazardous to other employees working in the direct vicinity, such as not ensuring attachments are secured to the forks and overloading by attaching platforms that are too large for the lift, increasing the likelihood of struck by incidents, tipping and rollovers.

29 CFR  1926.451(a)(6):Scaffolds were not constructed in accordance with the design by a qualified person:  On or about August 14, 2023 the employer S & G Stores II LLC DBA S & G Convenience Stores Store #90 at jobsite located at 900 American Rd., Napoleon, OH 43545, failed to ensure the scaffolding platform attachment (wooden pallet) used to elevate employees via a powered industrial vehicle (Yale lift truck - Model: GLP050LXNVAE087 S/N: A974V04070M), was designed, constructed and loaded on to the fork lift by a qualified person. An employee emptying garbage cans into a dumpster was exposed to a fall of approximately four feet from the scaffold.

29 CFR  1926.454(a):The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  On or about August 14, 2023 the employer S & G Stores II LLC DBA S & G Convenience Stores Store #90 at jobsite located at 900 American Rd., Napoleon, OH 43545, failed to ensure employees working from a yellow engineered forklift man basket, and while on wooden pallet scaffolds were adequately trained in the recognition of hazards associated with this type of scaffold. Untrained employees operating the unit in this condition were exposed to operational hazards, such as but not limited to, falls from height.
