29 CFR 1910.1025(d)(2): An initial determination was not made to determine if any employee may be exposed to lead at or above the action level:  At the commercial facility located at 302 N Oak Street in Bates City, Missouri 64011, on or about August 22, 2023, and thereafter: Employees were exposed to toxic or hazardous substances in the form of lead. The employees prime the different types of ammunition calibers, load them with granulated gunpowder, pack the ammunition, and ship it to customers. The employer did not conduct an initial determination as to the level of exposure to lead experienced by the employees.

29 CFR 1910.1025(e)(3)(i): Each employer shall establish and implement a written compliance program to reduce exposures to or below the permissible exposure limit, and interim levels if applicable, solely by means of engineering and work practice controls in accordance with the implementation schedule in paragraph (e)(1).  At the commercial facility located at 302 N Oak Street in Bates City, Missouri 64011, on or about August 22, 2023, and thereafter: Employees were exposed to toxic or hazardous substances in the form of lead.  The employer did not establish nor implement a written compliance program for lead exposure in their facility.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  At the commercial facility located at 302 N Oak Street in Bates City, Missouri 64011, on or about August 22, 2023, and thereafter: Employees were exposed to toxic or hazardous substances in the form of lead and other chemicals used tin the workplace. The employees prime the different types of ammunition calibers, load them with granulated gunpowder, pack the ammunition and ship it to customers. The employees perform equipment and machinery maintenance using lubricating oils, gasoline, and cleaning products. The employer did not establish a written hazard communication program for chemical exposure in the facility.
