29 CFR 1910.67(c)(2)(v): A body belt was not worn and lanyard was not attached to the boom or basket when working from an aerial lift. a) On or about 08/22/2023 during the removal of tree limbs located at 2126 Buffalo Rd. Rochester, NY; the employer did not enforce the use of fall protection to employees working in the basket of an aerial boom lift, 18 feet above lower levels. Employees were allowed to work in an articulating boom without the use of Personal Fall Arrest Systems and "tying off" to the boom basket with a lanyard. NO ABATEMENT CERTIFICATION REQUIRED
