29 CFR  1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i).  (a) On or about July 21, 2023, Building No. 78: An employee was plasma cutting a furnace stack on the roof approximately 12 feet from the ground while the employer did not provide fall protection.  No abatement certification is required for this item.

29 CFR  1910.134(e)(6)(i): The employer did not obtain from the physician or other licensed health care professional (PLHCP)  a written recommendation regarding the employee's ability to use the respirator.  (a) On or about July 21, 2023, Building No. 78:  The employer did not obtain a written recommendation regarding the employee's ability to use a respirator where they were required to wear a tight-fitting elastomeric respirator while they were performing Class III asbestos work (i.e., removing a furnace that contained asbestos).   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

(a) On or about July 21, 2023, Building No. 78: The employer did not have employees fit-tested where they were required to wear a tight fitting elastomeric elastomeric respirators while performing Class III asbestos work (i.e., removing a furnace that contained asbestos).   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.
