OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall, struck-by, and crushed-by hazards from structural collapse:  a) On or about August 23, 2023, approximately eight (8) employees were attempting to manually lift and place a prefabricated wooden gabled wall fabricated onsite for a new residential extension. The crew did not use any supports or other assisting devices to secure and stabilize the wall during the lifting and placement operation, exposing employees to an unplanned collapse of the wall, resulting in serious struck-by and crushing injuries.

29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury.  Location - 61 Dunstar Road, Bedford, MA.  On or about August 23, 2023, eight employees were not adequately instructed in the recognition and avoidance of unsafe conditions while conducting residential construction activities including but not limited to the erection and placement of a gable end wall manually, exposing employees to serious hazards with injury.

Location - 61 Dunstar Road, Bedford, MA.  On or about August 23, 2023, eight employees were not protected from falling or injury in two instances while working/walking at and near unprotected floor openings.  Instance A) First area located at the front section of the house over the new garage.  Instance B) Second area was the back of the house were the employees constructed a second floor deck.

Location - 61 Dunstar Road, Bedford, MA.  On or about August 23, 2023,  nine employees were ascending and descending stairwells that did not have at one railing.  Instance A) August 23, 2023, eight employees were ascending and descending a stairwell from first floor to second floor of the house that had no railing.  Instance B) September 27, 2023, an employee was ascending and descending a stairwell from the second floor to the third floor that had no railing.
