29 CFR  1926.501(b)(12): Each employee engaged in the erection of precast concrete members (including, but not limited to the erection of wall panels, columns, beams, and floor and roof "tees") and related operations such as grouting of precast concrete members, who is 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:  a) Job Site - Employees installed concrete floor panels onto the third floor of a building without the use of fall protection and were exposed to an approximate 35-foot fall hazard to the ground below, on or about August 22, 2023.  No abatement certification or documentation required.

29 CFR  1926.502(b)(13): When guardrail systems were used around holes which were used as access (such as ladderways), they were not provided with a gate, or were not so offset that a person could not walk directly into the hole:   a) Job Site - Employees used an extension ladder to access/egress the 2nd floor of the building, and the guardrail system used around the ladderway opening was not provided with a gate and was not offset so that a person could not walk directly into the hole, on or about August 22, 2023.   No abatement certification or documentation required.

29 CFR  1926.502(b)(9): The employer failed to ensure that wire rope used as a top rail was flagged at 6-foot intervals with high-visibility material:  a) Job Site - Wire rope guardrails were installed on the perimeter edges of the 3rd floor of the building, and the top rails were not flagged at 6-foot intervals with high-visibility material, on or about August 22, 2023.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
