On August 23, 2023, the employer did the employer did not ensure that employees were protected from injury in that employees were conducting roofing operations without the use of fall protection at heights over 10 feet. This condition exposes to employees to fall hazards.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access. a. On August 23, 2023, the employer did not ensure that employees were protected from injury, in that portable ladders which were used to access the roof of a new residential home had side rails that did not extend at least 3 feet above the upper landing or was secured. The employer did not protect employees against falls at heights over 10 feet. This condition exposes to employees to fall hazards.
