OSH ACT of 1970 Section (5)(a)(1): each employer shall furnish to each of its employees a place of employment which were free from recognized hazards that are causing or were likely to cause death or serious physical harm to employees: On or about August 15, 2023, and at times thereafter, nurses, Behavioral Health Associates, and other employees with direct patient contact, were exposed to workplace violence while working with patients presenting and exhibiting aggressive behavior. Generally, the occurrence of aggressive and assaultive behavior, and potential exposure to aggressive and assaultive behavior, occurred during patient care, during restraint holds with a resisting patient, when breaking up patient fights, and during 1:1 constant observation with patients.
