29 CFR  1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a. Jobsite - On or about August 22nd, 2023, the employer did not provide training to employees in recognizing and avoiding unsafe conditions, where employees were exposed to fall hazards without proper PPE.

29 CFR  1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:  a. Aerial lift - On or about August 22nd, 2023, the employees were exposed to fall hazards while working in the aerial lift basket without fall protection, where body harnesses with lanyards attached to the basket were not provided or utilized to prevent the fall hazard.

Jobsite - On or about August 22nd, 2023, employees engaged in roofing activities were exposed to fall hazards of over 30 feet, where fall protection was not provided or utilized to prevent the hazard.
