29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)  On or about August 22, 2023, employees were exposed to fall hazards while performing construction activities including masonry staining and the employer did not ensure a competent person conducted frequent and regular inspections of the worksite and equipment to identify the workplace hazards.

29 CFR  1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening is 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 m) above the walking/working surface, was not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system:   On or about August 22, 2023, an employee was exposed to a fall hazard of approximately 15 feet while performing construction work including masonry staining at a window opening and suitable fall protection was not used.
