29 CFR 1926.20(b)(2): Accident Prevention Responsibilities. It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part; such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On or about August 24, 2023, at 1004 Brett Favre Pass in Green Bay, Wisconsin, the employer did not ensure that a competent person was performing frequent and regular inspections that could have recognized fall from elevation hazards associated with employees working on a roof surface approximately 70 feet above surface level without utilizing fall protection equipment.

29 CFR 1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. a) On or about August 24, 2023, at 1004 Brett Favre Pass in Green Bay, Wisconsin, employees were exposed to a fall hazard while working on a roof surface approximately 70 feet above surface level without using fall protection equipment while installing flashing materials on exterior walls. b) On or about August 24, 2023, at 1004 Brett Favre Pass in Green Bay, Wisconsin, an employee was exposed to a fall hazard while receiving equipment at a roof edge approximately 70 feet above surface level without using fall protection equipment while removing materials form a Genie Telescopic Boom Lift basket positioned at the roof edge.
