29 CFR 1926.451(c)(1)(ii): Guys, ties or braces were not installed at the closest horizontal member for scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) and repeated vertically at locations of horizontal members every 20 feet or less thereafter for scaffolds 3 feet wide or less, and every 26 feet or less thereafter for scaffolds greater than 3 feet wide:  a) On August 23, 2023, employees were observed performing masonry work from a tubular welded frame scaffold where the frames were five feet wide and did not have the first tie, guy or brace installed at the closest scaffold horizontal member to the 4:1 height to base width ratio; 20 feet.  No abatement certification or documentation is required for this item.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level:  a) On August 23, 2032, employees working from frame scaffolding were exposed to fall hazards of greater than 25 feet.  No abatement certification or documentation is required for this item.

29 CFR 1926.602(d):  The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  29 CFR 1910.178(l)(1)(i):  The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a)  On August 23, 2023, the employer provided employees with a Lull 644B-42  Highlander forklift without ensuring they were competent to operate the equipment safely, as demonstrated by successful completion of forklift training and evaluation.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
