29 CFR  1926.100(a):  Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) On or about August 24, 2023, at the above addressed jobsite, an employee working on the ground, below commercial construction activities, was not wearing a hard hat to protect against falling materials and debris.

29 CFR  1926.102(a)(1):  The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. On or about August 24, 2023, at the above addressed jobsite, an employee using a cordless drill, did not wear safety glasses, thereby exposing the employee to the hazards associated with eye injuries.

29 CFR  1926.501(b)(1):  Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a. On or about August 24, 2023, at the above addressed jobsite, an employee performing carpentry operations from the 6th floor balcony was exposed to a fall, of approximately Sixty (60') feet, created by the presence of unprotected sides.    b. On or about August 24, 2023, at the above addressed jobsite, an employee performing carpentry operations from the 2nd floor balcony was exposed to a fall, of approximately Seventeen (17') feet, created by the presence of unprotected sides.
